Terms of service

By signing up for Fidz, you agree to these terms. They're written in plain English so you can actually read them. If anything is unclear, email hello@fidz.app.

Fidz is operated by Adrien Pouchard, sole trader (individual) (ABN 89 169 486 121), based in Shepparton, Victoria, Australia.

1. The service

Fidz is a software-as-a-service that lets local businesses run digital loyalty programs delivered through Apple Wallet and Google Wallet, including push notifications, automated Google review requests, and customer analytics.

2. Eligibility

  • You must be 18 years or older.
  • You must operate a legitimate business with the legal right to collect customer data.
  • You must comply with Australian Privacy Principles and any other applicable laws in your jurisdiction.

3. Plans, billing and trial

  • You get a 14-day free trial when you sign up — no credit card required.
  • After the trial, you choose a plan and provide a payment method via Stripe.
  • Plans are billed monthly in AUD. Fidz is not currently registered for GST, so no GST is charged on its fees (the operator's turnover is below the AUD $75,000 registration threshold). This will change if and when registration becomes mandatory.
  • Setup fees are one-time and non-refundable once the on-site setup has been performed.
  • Monthly subscription fees are prorated and refundable for the unused portion of a month if you cancel for cause (we breached the service-level commitments).
  • You can cancel anytime from the dashboard. Service continues until the end of the current billing cycle.

4. Your responsibilities

  • You must obtain customer consent before enrolling them — the Fidz scan page includes a consent line, but you should also disclose your loyalty program at the counter.
  • You must not enrol customers without their knowledge or consent.
  • You must not send push notifications that are misleading, deceptive, or in breach of the Australian Spam Act 2003.
  • You must not request Google reviews in exchange for rewards — Google may delist your business if you do.
  • You must keep your login credentials secure.
  • You are responsible for your customers' data — Fidz acts as a data processor on your behalf under our Data Processing Agreement.

5. Acceptable use

You may not:

  • Use Fidz for illegal activities or to promote illegal goods or services.
  • Send spam, harassment, hate speech, or content that violates anyone's rights.
  • Attempt to break, hack, or reverse-engineer the service.
  • Resell or rebrand the service without a written agreement (white-label is available — contact us).
  • Use the service to compete directly with Fidz.

We may suspend or terminate your account at our discretion if we believe these rules have been broken. We'll notify you in writing first when possible.

6. Your data

You own your data. Your customer list, visit history, and campaign content remain your property. You can export everything as CSV from the dashboard at any time.

We license your data only to provide the service and to improve it (in aggregate and anonymised). See the Privacy policy.

7. Service availability

We aim for 99.9% uptime, calculated monthly. Scheduled maintenance is announced at least 24 hours in advance. If we miss the SLA for two consecutive months, we'll credit you one month free. Push notification delays caused by Apple or Google's infrastructure are outside our control and not counted toward the SLA.

8. Liability

To the maximum extent allowed by Australian Consumer Law, our liability for any loss arising from your use of Fidz is limited to the fees you've paid us in the 12 months preceding the claim. We're not liable for indirect or consequential losses (lost profits, lost goodwill, etc.).

Australian Consumer Law guarantees that cannot be excluded continue to apply.

9. Indemnity

You agree to indemnify Fidz against claims arising from your misuse of the service, your breach of these terms, or your failure to obtain proper consent from your customers.

10. Termination

Either party can terminate at any time. Upon termination:

  • Your service stops at the end of the current billing cycle.
  • Your data stays available for 60 days for re-activation.
  • After 60 days, your data is permanently deleted.

11. Changes to these terms

We'll email you at least 30 days before any material change. Continued use after the effective date means you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of Victoria, Australia. Disputes go to the competent courts of that jurisdiction.
